Centralized information about all children in Russia and their parents through the Contingent system will go into the hands of private business and will be collected without the consent of their parents.

The experience of the pilot regions has shown that parents will not know what data has been collected for their children and families: parents will not get access to the information base "Kontingent".

Two days later - another letter from her:

"To be continued. Today, my daughter brought a questionnaire already from a comprehensive school. Nothing is mentioned there about the" Contingent ", but everyone asks for information - up to the place of birth of the parents.

It is not clear to me how this can help in organizing the educational process.

I called the teacher, she clarified - yes, this information is for the "Contingent". She said, like you, that you can refuse, but there will be problems with participation in olympiads and passing the exam.

Daughter - okay, she's in the 3rd grade, I hope to refuse for now, but over time, maybe this whole "Contingent" will collapse. My son is in 11th grade. I look forward with trepidation to similar papers from his school. Although, perhaps, I had already signed everything that the collectors needed before, I had not thought about it yet.

I did not find our city in the list of pilot regions of IS Contingent, but I see that "Contingent" has been feverishly implemented since September.

At first I heard about it from my husband - he works in a sports school. And last week they gave my daughter consent to sign at an art school, now in a general education school. Thank you so much for your feedback, I just feel in a vacuum, I don’t see like-minded people yet, and there is very little information about this beast on the Internet.

In general, I want to write that I agree only to non-automated data processing. Then act according to the situation."

By the way, the same mother wrote that her third-grader daughter, without her consent, was examined by a gynecologist at school, after which she was forced to write a refusal of medical intervention. But this is as a lyrical digression, back to the topic.

There are many reasons to raise the topic of creating a single interdepartmental base "Contingent" for all the children of Russia. The main thing is that the IS "Contingent" from a seemingly fantastic project of the Ministry of Education and the Ministry of Communications has become a reality.

This is confirmed by the draft law No. 1048557-6 "On the creation of the state system" Unified federal interdepartmental system for accounting for the contingent of students in basic and additional educational programs ", which has been in the State Duma since April 2016 and has already been adopted in the first reading on June 10, 2016, and tenders held in the regions, and letters from the regions, and a single website of the system, and disturbing information from education staff.

At the disposal of the Editorial Board of RIA "Ivan Chai" information was received from one of the leaders of the education sector of one of the regions of Russia in the summer of 2016:

“I am sending you a letter, in my opinion, with very important insider information regarding the personal data of all children under 18 years old in the territory of the Russian Federation.

Yesterday, an interdepartmental meeting was held in the city for the heads of correctional boarding schools, SPO institutions, and the penitentiary service. Topic: introduction of the "Contingent" database for registering children under 18 years of age.

The program is federal. On the ground, the performer is raffled off by auction. In our region, the State Institution "...." is responsible for the technical side, and the Institute for Improvement is responsible for the "stuffing".

As the deputy minister of education of the region V., who held the meeting, said, the base has already been introduced in preschool education.

Next in line are state educational organizations and municipal schools (meeting today). The deputy minister referred to the Decree of the Government and the order of the President of the Russian Federation (he did not name the number).

Even more strange: when at the end of the meeting the director of one college asked to send an information letter to everyone, he was denied this ...

As always, everything is in a hurry: in July-August, an employee from each institution must undergo training and by 01.09. enter personal data on all students into the system.

As far as I understand, the deadlines have been set for the Russian Federation - until 11/30/2016.

To begin with, we are talking about the personal data of students, curricula / work programs. The program itself is very capacious: it even includes electronic diaries / electronic journals. In the future - a complete rejection of paper media.

These are the pies...

So it is obvious that not only parents are concerned about the Contingent system.

At the federal level, the introduction of the IS "Contingent" system is carried out by the Ministry of Education and Science of the Russian Federation on the basis of the Government-approved Concept for the Creation of a Unified Federal Interdepartmental System for Recording the Contingent of Students.

The Ministry of Education believes that the creation of the AIS "Contingent" will improve "the efficiency of managerial decision-making related to the development of children's education, health care, social security, as well as other areas focused on working with children."

The implementation of the AIS "Contingent" is carried out in three stages:

At the first stage, the educational organization must enter into the system

1) personal data of the child

(full name, date and place of birth, gender, SNILS, citizenship, details of a birth certificate or other identification document, address of registration/actual place of residence/stay)

2) personal data of parents/legal representatives

(full name, date of birth, SNILS, citizenship, details of an identity document).

At the second stage, additional special information will be added

(Health data: health group, medical group, group and cause of disability, need for an adaptive learning program, need for long-term treatment),

It is noteworthy that it is not government agencies that create the IS CONTINGENT containing all personal data for all 28 million Russian children and their parents.

No one knows what responsibility for the security of data storage is provided for by a motley regional LLC, OJSC, CJSC, to which, within the framework of a public-private partnership, huge accumulations of personal data are transferred - no one knows.

What security guarantees these companies and firms can provide is also unknown.

For example, for Tomsk IS "Contingent" will be developed and implemented by OJSC "Rostelecom".

In Perm, in the tender for the RENDERING OF SERVICES TO CREATE THE SUBSYSTEM OF THE COMPREHENSIVE INFORMATION SYSTEM OF EDUCATION, the advantages were given to "small businesses and socially oriented NGOs".

The tender was won by the Perm company CJSC "BIONT", the form of ownership is private. For the creation of the Contingent base for the Perm Territory, this company, established in 2012, will receive 8 million 400 thousand budget rubles.


According to the website of the Perm School No. 59 in the Presentation for Parents, "parents and teachers do not have access to the Contingent database."

Moreover, on the website of the Perm Lyceum No. 9, in clarifications from 2015, there is information that in the near future, the consent of parents to provide personal data of their children for Contingent will no longer be needed. They will simply be OBLIGED to provide all the information:

"At the federal level, a package of regulatory documents and amendments to federal legislation is being prepared, which will be adopted in the spring of 2016, OBLIGING parents / legal representatives to provide personal data on children and parents to the regional educational system."

And why consent? Already now, the Deputy Head of the Office of the Federal Service for Supervision in the Sphere of Communications of Penza Seknin A.L. assures in response to a request for consent to the provision and processing of personal data that consent is not required.

"According to paragraph 2 of part 1 of article 6 of the Federal Law of July 27, 2006 No. 152-FZ "On Personal Data", the processing of personal data without the consent of the subject is allowed if it is necessary to achieve the goals provided for by an international treaty of the Russian Federation or the law , for the implementation and fulfillment of the functions, powers and duties assigned by the legislation of the Russian Federation to the operator.

Thus, if an educational institution processes personal data to the extent and in cases stipulated by the requirements of the legislation of the Russian Federation, the operator does not need to obtain consent to the processing of personal data.

In all regions of Russia, the regional ministries and departments of education have long been engaged in the formation of the base of the IS "Contingent".

Thus, in Moscow, by Order of the Department of Education of the City of Moscow dated December 4, 2015 No. 3511 "On assigning educational organizations to microdistricts (territories) of the city of Moscow", all streets of the city are assigned to specific schools on a territorial basis. These schools are "responsible" for collecting data on children from the streets attached to them for the IS "Contingent".

The official goals of the innovation are to facilitate the work of officials, improve quality and efficiency, electronic interaction between the IS of various departments, improve public awareness of educational organizations and educational services provided.

IS "Contingent" includes federal and regional segments.

The federal segment will collect, centrally store, process the register of personal data of students and their legal representatives, the register of organizations, information coming from the regional segments of all subjects of the Russian Federation, the higher education segment, information systems of federal government bodies and state non-budgetary funds.

Regional segments will accumulate information about "persons" (as the documents say) and organizations and carry out interdepartmental consolidation of this data and transfer to the federal system.

35.76 million federal budget funds were allocated for the construction of the IS. MegaFon, which attracted the BARS Group company, acted as the general contractor in the project; and the FAS has already declared collusion upon receipt of the tender; Rostlecom is also one of the contractors, and Dnevnik.ru was noticed among the regional operators, which, together with Reform LLC, is working to introduce the regional segment of IS Contingent into the information infrastructure of the Moscow Region.

IS "Contingent" is an electronic database of all children in Russia, their parents and everyone who receives educational services of any kind - be it a kindergarten, school, creative center, vocational school, university, advanced training courses or a dance club; It also includes employment information.

The file for a child is opened from the moment of his birth and registration in the registry office, and is closed after his death; the single identifier of the student in the interdepartmental system is the insurance number of the individual personal account (SNILS).

The student's personal data (at any level of education, from kindergarten to university) includes general information (last name, first name and patronymic, gender, place of birth, date of birth, birth certificate number, date of state registration of birth and name of the body that made state registration of birth, citizenship, series and number of a passport or details of another identity document, address of registration, SNILS), as well as data on the stages of education, on achievements (portfolio).

The list is not limited to this list: the category "other information necessary to solve the problems of the interdepartmental system" includes information about the "person" from the bowels of the Ministry of Health, the Federal Tax Service, the Federal Migration Service, the Pension Fund, the Ministry of Labor, Rosobrnadzor, etc.

The Ministry of Health will oversee the saturation of the file with profile information: health group, medical group, group and cause of disability, the need for an adaptive training program, the need for long-term treatment, decisions of psychological, medical and pedagogical commissions, etc.

In addition to these data, the IS indicates the degree of adaptation of the student at all stages of education, and also forms a "portfolio" for each child, the data of which will be analyzed by the federal system, as a result of which the child with certain achievements will be assigned the attribute "gifted child".

It will be mandatory to enter into the IS information about the parents / legal representatives of the student: last name, first name, patronymic, citizenship, registration address, registration address at the place of residence (at the place of stay), series and number of the passport or details of another main identity document, SNILS.

Also in the regional segment, data on the "parent-student association" is provided.

For parents who do not agree with such requirements, a package of regulatory documents and amendments to federal legislation is being prepared at the federal level, which will be adopted in the spring of 2016, and which will oblige parents / legal representatives to provide personal data on children and parents to the regional educational system .

In the instruction entitled "Unified functional and technical requirements for the regional segment of the unified federal interdepartmental system for accounting for the contingent of students in basic educational programs and additional general educational programs" on 69 sheets, a lot of attention is paid to describing how exactly to transfer from the registry office, among other things, information about changing the surname and the date of birth of the child, which occurs only upon adoption, and has always been information that is not subject to disclosure.

At the webinar of the Informatization Projects Department of the Ministry of Communications of Russia, when explaining the creation and operation of the regional segments of the IS "Contingent", the organizers dispelled the fears of the representatives of the regions: "The specified personal data of the child can be transferred by the registry office if this is indicated in the relevant cooperation agreements."

In connection with the creation of the IS "Contingent", it is planned to amend Laws No. 152-FZ "On Personal Data", No. 273-FZ "On Education in the Russian Federation", as well as the Information Society program for 2011-2020.

In the "pilot" mode, the project is being implemented in the Irkutsk, Moscow, Yaroslavl, Saratov regions, the Republic of Dagestan, Tomsk, Perm Territory, and Kamchatka.

And now - about what it brings to all of us.

So, a unified information system is being created in Russia, when an electronic file with an individual life number is immediately opened for each resident upon birth, and where absolutely all information about him is collected. It is very convenient, and you do not need to spend money on issuing electronic cards.

The name of the IP program "Contingent" is indicative - in relation to the huge masses of people, and in other words, to the people, to the nation. In our semantic field, this is something habitually undeveloped, with its own "cockroaches", which can neither be educated nor corrected. In a word, contingent what to take from it?

The primary emphasis in IS is on the state of health, success (portfolio), the relationship of the child with his parents.

As for the parents, this lies on the surface: to file information about the insufficient "association of parents and the child" - and no law on domestic violence, which has been stalling for so many years, is no longer needed.

Portfolio - the basic principle of dividing children into castes, tested in the project of the Kudrin Foundation in Transbaikalia, implemented in the Education Modernization Project, rating schools and universities, the project of the higher school "Tuning" - for segregation of the "undeveloped" and the washing out of talents and intellectual resources outside of Russia.

As for health information, by a strange coincidence, on January 1, 2016, the Order of the Ministry of Health dated December 25, 2014 N 908n "On the Procedure for Diagnosing Brain Death", came into force on January 1, 2016, where paragraph 1 says that a posthumous donor is now considered a person aged 1 year or older. And, therefore, it is very important for the IS customer to have information about the health status of potential posthumous donors.
Access to the "person" file in the IS will be limited to a certain circle of people, which does not include the data subject himself or his relatives - he will not be able to control the correctness and impartiality of information about himself, and at the same time, only on the basis of this information, some operators will model his life trajectory.

And who will ensure the protection of this array of information wealth, the monopoly right to dispose of which is left to the Ministry of Education?

And, finally, the most important thing: what happened to our Constitution? Canceled all or in parts?

For example, article 23: item 1: "Everyone has the right to privacy, personal and family secrets, protection of his honor and good name."

Or Article 24, paragraph 1: "The collection, storage, use and dissemination of information about the private life of a person without his consent is not allowed."

Or Article 24, paragraph 2: "State authorities and local self-government bodies, their officials are obliged to provide everyone with the opportunity to familiarize themselves with documents and materials that directly affect their rights and freedoms, unless otherwise provided by law."

What, the state has already ended, and everything is now going on "according to concepts"? They didn’t ask anyone, didn’t discuss it with anyone, but simply ordered it - and off they went: officials are studying the issue, IT people are standing in line for grants, lawyers are scribbling laws against those who disagree with this state of affairs.

The preparation of the project is expected to last three years, and the Deputy Prime Minister Olga Golodets requires launching the Contingent Information System in two: an urgent need is for a system that takes control of everyone - in any corner of the country, in any place and in any capacity, from birth to death.

Parliament is making new attempts to introduce the "Contingent", the law on the implementation of which was rejected at the beginning of the year Russian President Vladimir Putin. Last week, the fate of another Russian juvenile project was discussed at a meeting of the Education Committee in the State Duma. The deputies were not ready to remove the rejected bill from consideration and decided to convene a special commission to prepare an agreed text of the law on the "Contingent" with the participation of parents.

Project GIS "Contingent of students" has been discussed for about three years now, it is currently being tested in the Irkutsk, Moscow, Yaroslavl, Saratov regions, the Republic of Dagestan, Tomsk, Perm region and Kamchatka. In these regions, for several years now, data on children has been collected from parents in a "pilot" mode. The scheme is simple: when a child is placed in a kindergarten or school, parents provide basic personal data - full name, citizenship, registration address, SNILS. Later, when the child begins to go to school, data on his progress enters the system. It comes through " electronic diary", which can only be entered by the SNILS number. The database is also updated with information about the child's health and hobbies.

The public was alerted that access to the systematized data of the child was forbidden to them. The administration of educational institutions and officials of the Ministry of Education have it. But since no one asked the parents' opinions, the bill was successfully adopted in three readings and by the Federation Council.

The president also doubted the thoroughness of the decision taken by the parliament. He expressed confidence that this law should establish a list of specific information contained in the federal and regional systems, as well as determine the persons who will have access to such information, and their responsibility. The Kremlin explained that by rejecting the law, Putin took into account the public concern that had arisen and considered it necessary to finalize the law in order to protecting the interests of parents and children.

The speaker of the State Duma is sure that such a law is necessary, because " there are a large number of databases in the field of education, and they, unfortunately, are all made on different platforms and are not very secure Volodin said. - Creating a common database on a single secure platform, in my opinion, that would be right".

What the chairman of the parliament considers right, activists of public organizations call a direct violation of the law. Public activists categorically oppose the collection of personal data. "The public sees no need for such an information system. Each department already has its own database, which allows them to clearly track, for example, the Ministry of Education, the need for educational institutions; how many children will be in the first grade, polyclinics and registry offices, heads of social departments also know the necessary information. We have a lot of departments that collect the information they need for their work, but there is no need to make it massive and extensive. Earlier, the tender for the development of "Contingent" was received, among other things, by the owner of the service "Dnevnik.ru", registered in Cyprus, Gabriel Levy, which already has access to information about all the students in the country.

We cannot control what is written about us there, and we cannot regulate this process in any way. A system of external control over a citizen is being created, a system of access to information about him which is created forcibly, without informing and consenting to the citizen, as a result, he remains completely defenseless in this situation. We are creating a system in which everything will be written about us. But no one will ask us about what exactly they want to put in there, and no one won't show what's in there.- added Lyudmila Ryabichenko.

Besides, "Contingent" contradicts Articles 23 and 24 of the Constitution.

Expert of the Parental All-Russian Resistance (RVS) Alexander Kovalenin notes that the President's rejection of the draft law on the introduction of GIS is connected precisely with this.

"The President's instruction "that the Federal Law should establish a list of specific information contained in state information systems", made by him when he rejected the law, is not just a wish of the first person of the state, but a demand of the guarantor of the Constitution to eliminate the contradiction with the fundamental law. According to the Constitution citizens have the right to personal family secrets(Article 23), the collection, storage, use and dissemination of information about the private life of a person without his consent is prohibited, and authorities and local governments are obliged to do the opposite of what this law required - observe privacy guarantees(Article 24). In fact, "Contingent" allows the collection of data about our children by any body that wants it. In particular, to guardianship authorities, which today do not have legal grounds to keep records of children, except for those "left without parental care", but really want this. The creation of the system, according to the Ministry of Education of the Russian Federation, is aimed at the good: to establish the required number of places in kindergartens and schools, to issue grants to gifted children. The RVS activist, in turn, believes that the "Contingent" infringes on the rights of lagging behind students.

“The system will collect not only school successes, but also information about troubles. All “intermediate” twos. And those who, experiencing difficulties, picked them up and fell behind in their studies, in such a system they are unlikely to be able to catch up with their chances to get settled in life. And taking into account the above, information about social ill-being will also accumulate, which now, according to the law, should not go beyond the police department for juvenile affairs ... It is convenient for a child to have a label with his "value" - the so-called portfolio. his educational pedigree, which would be considered without his consent (!) by everyone who needs children for anything - and foreign "bounty hunters", and show business dealers, and "potential adopters" who are waiting in line for "jar of orphans" when the baby is taken away for them. Do we want children to be watched without our knowledge? In the end, anyone who wants to send their successful child somewhere for grants could apply for grant competitions himself"- added Kovalenin.

The prospect of being "under the hood" thanks to the "Contingent" frightens parents too. They write about their fears on social networks.

The collection of personal data is not necessary - data must be recorded where it occurs and for strictly defined purposes: school - at school, medical - in the hospital, police - in the police.
